FacilMenus Terms & Conditions

These Terms govern access to FacilMenus websites, dashboards, QR menus, ordering tools and related services. By creating an account or using the service, you agree to them.
1. The platform
FacilMenus provides technology that restaurants use to publish menus, receive requests and manage orders. Each restaurant is responsible for its menu, prices, taxes, availability, preparation, service, refunds and compliance with applicable food, alcohol and consumer laws. FacilMenus is not the restaurant or seller of the food and beverages shown.
2. Accounts and security
You must provide accurate information, protect login credentials and promptly report suspected unauthorized access. Restaurant owners are responsible for staff permissions and activity under their accounts. You may not probe, disrupt, reverse engineer, upload malicious code, bypass access controls or use the service unlawfully.
3. Plans, trials and payments
Plan features, trial periods, pricing and billing terms are those displayed when you subscribe. Fees are due as stated at purchase. Cancellation stops future renewal unless otherwise shown; prior charges are non-refundable except where required by law or expressly agreed in writing. Third-party payment providers may apply separate terms.
4. Restaurant content and orders
Restaurants retain responsibility for the text, images, trademarks and other content they upload and grant FacilMenus permission to host and display that content to operate the service. Customers must review order details before submitting. Orders may be accepted, declined or adjusted by the restaurant when an item is unavailable or information is incorrect.
5. Intellectual property
FacilMenus, its software, design and branding are protected by intellectual-property laws. Except for the limited right to use the subscribed service, no ownership rights are transferred.
6. Availability and disclaimers
We work to keep the service reliable and secure, but uninterrupted or error-free operation is not guaranteed. To the maximum extent permitted by law, the service is provided “as is” and “as available,” without implied warranties.
7. Liability
To the maximum extent permitted by law, FacilMenus is not liable for indirect, incidental, special or consequential losses, restaurant acts or omissions, food quality, allergens, payment-provider failures or events outside our reasonable control. FacilMenus’ aggregate liability for a claim will not exceed the fees paid for the affected service during the preceding twelve months. Rights that cannot legally be limited remain unaffected.
8. Suspension and termination
We may restrict or terminate access for nonpayment, security risk, unlawful use or a material breach. You may stop using the service at any time, subject to outstanding payment obligations.
9. Changes and governing law
We may update these Terms and will post the revised date. Material changes take effect after reasonable notice when required. These Terms are governed by the laws applicable where the FacilMenus operator is established, subject to any mandatory consumer protections that apply to you.
